Canada's New "Citizenship By Descent" Law - Bill C-3 - It's Now Law!

Citizenship by descent when an individual is born to a Canadian citizen parent depends on HOW the parent became a Canadian citizen. Category 1: Individuals born outside of Canada to a Canadian Citizen parent who was born in Canada or naturalized as a Canadian citizen, will continue to be Canadian citizens from birth. Category 2: Individuals born outside of Canada to a Canadian Citizen parent who was born outside of Canada, will: 1. Be eligible for a Canadian passport if born before the passage of Bill C-3. 2. Be eligible for a Canadian passport if born after the passage of Bill C-3 IF the Canadian citizen parent had 1095 days (three years) of physical presence in Canada prior to the birth of the individual.
